How do i download while using the US version in a EU console?

I want to get on using SmileBASIC, but the problem is i can't be able to download other projects because i'm using a hacked 3ds. I'm using the american version therefore it's obvious that i always get to agree the terms over and over.

Stop using a pirated copy. Import a us system.

That's quite an investment over a $10 game. Buy anyway, this community is pretty harsh against piracy. Good luck getting a straight answer.
