Is it right for Nintendo to take down third party games from the eShop because of exploit purposes but not take down first party games?[poll=p22][/poll]

Nintendo can't just pick and choose which software gets pulled for exploits. They either do it to all or do it to none. Indies (I haven't seen any other third parties being pulled from digital for exploits, please fill me in if I'm wrong) being shafted makes them look as though they aren't first-class citizens, which is hard enough considering how small they are. Maybe Nintendo decided not to pull OR/AS because it's also physically available. Even if this is the case, pulling it from digital significantly raises the entry barrier because then physical copies become even more valuable among hackers. There's a limited supply of physical games but not digital (until the game becomes somehow unavailable of course), and pulling digital shuts out that infinite availability.

This looks like an issue because I think the exploit works on the up-to-date game too so they're gonna have to update the eshop title and release a new patch.

As a fellow indie, I pray to the indie gods every night, pleading with them that I don't lose my game to a glitch that can be easily fixed (take browserhax, for example).

What, does Nintendo not have it in their infinite power to push a patch? If Nintendo wanted these patches made, they'd pay their Indies more money to fix them. This shouldn't have to be a problem.

In the end, Nintendo gets like 99.99% of the profit anyways, so better that :P
