Smilebasic has returned to the JPN eshop at this time, bringing the version up to 3.3.2.
This is off-topic, but they also added a page about distribution policy. I can't really tell, but it seems to be saying that no, you can't enforce control over any materials you distribute via public key, anything you distribute is copyleft by nature and they don't want to go chasing down uses that the creator doesn't like.
