I knew it was a risk. Even though the original GYRUSS is from 1983 and hasn't been released on a system since the DS version circa 2000... I cannot argue with the definition of Copyright. (The guys at KONAMI have been known to flex their muscles before .. glad it was only REJECTED) For those who took the time to download and evaluate the game, I really appreciate your sincere feedback. Time to get back to work...

Wait, how does this infringe on copyrights though? It has a different name, different art, different music... (Unless someone thought Bach was copyrighted or something.) I guess just being a clone was bad enough?

This really does suck, you did a very good job with this. I could see why Konami would find a reason to strike this (especially considering their behavior as of late) but the fact that it actually happened is just unfortunate. As Lumage said, it was more than likely just some dude reporting it for infringement, which is just a really lame thing to do when you only really use the concept of the original as a base. If this were disputed you may have a chance, but more likely not. Sorry this has to happen :-[ There's always alternative file transfer methods like PetitModem, I guess.

Can someone with homebrew capabilities upload CYCLONE's files so it isn't completely erased from human history due to one idiot false-flagging for infringement? This crap makes me furious, and more people should take a stand against it.

I've contacted SmileBOOM to see if there is any recourse for false flagging. Or if they can at least take a second look to make sure it wasn't swept up by a an automated process that might be erroneous. cujo1992, they may ask for additional information, like your NNID or the program key (both of which I do not have). If you aren't comfortable sending that to me in a PM. I'm happy to forward you the email chain once I hear back from them.

Dr.Zog I dont have any home brew set up on my system for fear it will wreck my kid's 3ds (yeah - kinda pathetic). If I could figure that out... Where could I put the files?

there's always encryption. of course it can still get reported, but they won't see it during their normal checks. (and yes, I think they do review programs that aren't reported, but it probably happens a few days after upload.)

I wish they would send you a reason why they remove your program. Even just an automated "your program broke one or more of the following rules" My purely original "game" was taken down with no explanation after a week and all I had to do was remove the curse words to get it back up. Funnily enough, when I first played this I thought "hey, this is kinda like Tempest!" Which isn't a Konami game, it's by Atari and I believe it came before Gyruss. There was a lawsuit, Capcom v. Data East, which basically ruled that mechanics of a game in a purely functional form cannot be protected unless they also serve some kind of artistic purpose or something (legal speak is strange...) So if it was in fact them, they don't really have a leg to stand on in terms of copyright. However! In the purchase of SB you are legally bound to a contract that states SmileBoom can drop your content if it gets reported. So you don't really have a leg to stand on either. It's a lose/lose. If I had any weird crackpot advice to give it would be this: don't mention the game you're basing it on in theb official publishing, nor in the game itself. Crediting your bases and inspirations is great, but I wouldn't be surprised if someone soiled their pants over the fact you used the word "Konami" without a permit. Just some food for thought. That isn't to say it's YOUR fault; it isn't. But stupid claims are stupid, so who knows?

I thought about this when I posted the game. Anyone who knows GYRUSS would immediately recognize it - and I didnt want to claim the inspiration was my own... especially not with this community. I suppose I could have said "a game from 1983 that rhymes with [spy-puss] and designed by a company that doesnt have a plumber for a mascot". (Hmm... that is pretty catchy) Oh - and no worries about "fault". I do take ownership for this one... my next game will be more original. Thanks!

either upload the original files to the 3DS with petit modem or inject the raw files into the extra save data using some tool (you might have to create a folder first in SmileBASIC, not sure about the files).
